Section 1 - About these Terms, Scope and Acceptance

1.1  Who we are.

Elevate Golf is operated by Elevate Golf International Limited (“Elevate Golf”, “we”, “us”, “our”). We provide a global, on-demand marketplace that enables golfers (“Players”) to obtain short, personalised coaching tips (“Tips”) from verified professionals (“Coaches”) across swing, fitness, mental game, nutrition and equipment advice, delivered via video, image or text within our mobile and web applications (the “Platform”).

1.2  Contractual effect.

These Terms & Conditions (“Terms”) form a legally binding agreement between Elevate Golf and any person who creates an account or accesses the Platform in the capacity of a Player or a Coach (together, “Users”). By creating an account or using the Platform, the User accepts these Terms in full. If a User does not agree, the Platform must not be used.

1.3  Related policies.

These Terms incorporate and should be read alongside our Privacy Policy, Cookie Policy, Acceptable Use Policy, Refunds & Cancellations Policy, and Intellectual Property Infringement Policy (together, the “Policies”). Where there is any conflict, these Terms prevail unless a Policy expressly states otherwise to comply with law. Links to the Policies are provided on the Platform footer and within account settings.

1.4  Marketplace nature; no subscription.

Elevate Golf facilitates micro-transactions for Tips on a pay-per-Tip basis. There are no subscriptions. Pricing is set within ranges displayed on the Platform and shown before any purchase. Elevate Golf never stores payment card data; payments are handled directly and securely by PayPal. Elevate Golf receives transaction confirmations only to enable order fulfilment, platform integrity and accounting.

1.5  Eligibility and minors.

The Platform is currently available only to individuals aged 18 and over. If we detect an attempt to register by someone under 18, registration is not permitted and the individual is informed that a junior account type is under development. No account for under-18s will be created at this time. Further eligibility requirements are set out in Section 3.

1.6  Territorial scope.

The Platform is made available globally, subject to applicable local laws and any geographic or regulatory restrictions we may apply from time to time. Certain features may not be available in all countries. Users are responsible for ensuring that access and use are lawful in their location.

1.7  Changes to these Terms.

We may amend these Terms where necessary (for example, to reflect legal, regulatory, security or operational updates). Material changes will be notified by appropriate means (e.g., in-app notice or email). Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If a User does not agree to changes, the account should be closed and use must cease.

Section 2 - Definitions and Interpretation

2.1 Definitions.

In these Terms, unless the context requires otherwise:

  • Account means a registered user profile created on the Platform by a Player or a Coach.
  • Coach means a verified professional authorised by Elevate Golf to provide Tips to Players through the Platform.
  • Coach Agreement means the separate contractual terms between a Coach and Elevate Golf governing a Coach’s participation on the Platform.
  • Content means any material uploaded, submitted or transmitted on the Platform, including Player requests, videos, images, audio, notes, annotations and Coach responses.
  • Intellectual Property Rights means all intellectual property rights of any kind (registered or unregistered), including copyright, trade marks, design rights, database rights, and related rights.
  • PayPal means the third-party payment processor used to facilitate payments in connection with the Platform.
  • Player means a registered individual who purchases Tips through the Platform.
  • Policies means Elevate Golf’s Privacy Policy, Cookie Policy, Acceptable Use Policy, Refunds & Cancellations Policy, Intellectual Property Infringement Policy, and any additional policies we publish from time to time.
  • Platform means the Elevate Golf mobile application(s) and in-app services that enable Players to obtain Tips from Coaches. For clarity, the Platform does not include the public-facing Elevate Golf website.
  • Tip means a short, personalised piece of coaching advice delivered by a Coach in response to a Player’s request, provided via video, image, audio or written message.
  • User means any Player or Coach who accesses or uses the Platform.
  • Website means the public-facing Elevate Golf website provided for general information only. Use of the Website is governed by the Website Use section of these Terms.

2.2 Interpretation.
(a) References to “including”, “in particular” or similar expressions are illustrative and do not limit the generality of the preceding words.
(b) Words in the singular include the plural and vice versa.
(c) Headings are for convenience only and do not affect interpretation.
(d) References to legislation include amendments, re-enactments and replacements of that legislation.

Section 3 - Eligibility, Accounts and Registration

3.1 Eligibility - Players.
Players must be at least 18 years old at the time of account creation. By registering as a Player, the individual confirms they meet this requirement. The Platform does not permit accounts for anyone under 18. If an under-18 attempt is detected during sign-up, the process is blocked and no account is created. Elevate Golf does not retain the personal details of individuals whose registration is blocked.

3.2 Eligibility - Coaches.
To register as a Coach, an individual must:
(a) be at least 18 years old;
(b) complete Elevate Golf’s verification process to our satisfaction, which includes providing proof of a recognised coaching qualification; and
(c) maintain a valid PayPal Business Account to receive payments.

3.3 Verification.
Coaches are required to provide accurate information and materials during the verification process. Approval is at the sole discretion of Elevate Golf. Meeting verification standards is a condition of using the Platform as a Coach. Elevate Golf may suspend or refuse verification if requirements are not met.

3.4 Account Accuracy.
Users must ensure that all details provided during registration are true, accurate and kept up to date. Users may not create accounts on behalf of others without permission.

3.5 Account Responsibility.
Each User is responsible for maintaining the security of their account and for all activity carried out under it. Accounts may not be shared or transferred. Users must notify Elevate Golf immediately if they believe their account has been compromised.

3.6 Platform Functionality.
Certain features of the Platform will only be available after required account steps are completed. For example, a Coach cannot begin providing Tips until verification has been approved and a Tip rate has been set within the Platform.

Section 4 - Use of the Platform

4.1 Permitted Use - Players.
The Platform is provided to Players strictly for personal, non-commercial purposes. Players may request and receive Tips solely for their own use and must not resell, redistribute, or otherwise exploit any Tip or related content.

4.2 Permitted Use - Coaches.
Coaches may provide Tips only through the Platform. All Player–Coach interactions, and all payments for Tips, must take place within the Platform. Coaches must not solicit or accept payments outside the Platform for services arranged through it.

4.3 Intellectual Property.
Coaches retain ownership of the Tips they create, and Players retain ownership of the submissions they provide. Elevate Golf does not acquire ownership of any content. When a Tip is purchased, the Player receives a personal, non-transferable licence to use that Tip for their own private purposes. Intellectual property rights, and Elevate Golf’s limited licences to operate the Platform, are set out in detail in Section [X].

4.4 Unacceptable Conduct.
Users must not:
(a) upload or transmit unlawful, offensive, harmful or misleading content;
(b) harass, abuse or exploit another User;
(c) attempt to circumvent payments or transact outside the Platform;
(d) misuse the Platform in any way that compromises security, integrity or fairness.

Further rules are set out in the Acceptable Use Policy.

4.5 Account Suspension and Termination.
Elevate Golf may suspend or terminate an Account immediately if we believe a User has breached these Terms, the Acceptable Use Policy, or applicable law; engaged in fraud or misconduct; or otherwise acted in a way that harms Players, Coaches or the Platform.

4.6 Independence of Coaches.
Coaches are independent professionals and are not employees, agents, or representatives of Elevate Golf. Elevate Golf is not responsible for the content of any Tip or for the conduct of any Coach. Likewise, Elevate Golf is not responsible for harmful or inappropriate content submitted by Players. Users interact with one another at their own risk, subject to these Terms and the Acceptable Use Policy.

Section 5 - Payments and Pricing

5.1 Payment Method.
All payments for Tips are processed directly by PayPal. Elevate Golf does not collect or store payment card details, and does not hold funds on behalf of Players or Coaches.

5.2 Currency.
Payments are processed in United States Dollars (USD). Where a Player’s account or card is in another currency, PayPal applies its own conversion rates and any applicable charges. Elevate Golf has no control over such rates or charges.

5.3 Pricing.
The price of each Tip is set by the Coach within the range displayed on the Platform. Players are shown the price before confirming a purchase.

5.4 Taxes.
All Tip rates shown to Players are inclusive of any applicable taxes. Coaches are solely responsible for determining, reporting, and paying any taxes arising from the Tips they provide.

5.5 Refunds and Cancellations.
Refunds and cancellations are managed in accordance with Elevate Golf’s Refunds & Cancellations Policy. That Policy explains when a Player may be refunded, when a Coach may decline a request, and the effect on both parties.

5.6 Non-Refundable Fees.
PayPal processing fees are not refundable.

  • Where a Player withdraws a Tip request before a Coach has begun working on it, the Player bears the processing fee.
  • Where a refund is made after a Coach has provided a Tip (whether by the Coach’s choice or by Elevate Golf), the non-refundable PayPal fee will be borne by the Coach.

5.7 Chargebacks.
Players agree not to dispute or reverse payments through PayPal or their card provider except in cases of genuine unauthorised use. All refund requests must be made through the Platform and handled under our Refunds & Cancellations Policy. Elevate Golf reserves the right to suspend or terminate Accounts that are subject to chargebacks.

5.8 Receipts.
Elevate Golf does not issue receipts or tax invoices. All receipts and transaction records are generated by PayPal. Players and Coaches must access their payment history directly within their PayPal accounts.

Section 6 - Ratings, Reviews and Feedback

6.1 Player Ratings.
After receiving a Tip, Players may rate and review the Coach who provided it. Ratings and reviews must be fair, accurate, and reflect the Player’s genuine experience.

6.2 Coach Feedback.
Coaches may receive ratings and reviews from Players but may not rate Players. Coaches are encouraged to view feedback as constructive.

6.3 Content Standards.
All ratings, reviews, and feedback constitute User Content and must comply with these Terms and the Acceptable Use Policy. Reviews must not be unlawful, defamatory, offensive, misleading, or otherwise inappropriate.

6.4 Moderation.
Elevate Golf reserves the right, but is not obliged, to monitor, edit, refuse, or remove any rating, review, or feedback that breaches these Terms or the Acceptable Use Policy, or where we reasonably consider removal necessary to protect trust and fairness.

6.5 Use of Feedback.
By submitting a rating or review, the Player grants Elevate Golf a non-exclusive, worldwide, royalty-free licence to display, reproduce, and use that content in connection with the operation and promotion of the Platform.

6.6 No Endorsement.
Ratings, reviews, and feedback reflect the views of Users only. Elevate Golf does not verify or endorse any review, and is not responsible for its accuracy.

Section 7 - Intellectual Property and Content Rights

7.1 Ownership of User Content.
All content uploaded or created through the Platform remains the property of its creator.

  • Coaches retain ownership of the Tips they create.
  • Players retain ownership of the videos, images, or text they submit.
  • Elevate Golf does not claim ownership of any such content.

7.2 Licence to Players.
By creating and delivering a Tip, the Coach grants the relevant Player a perpetual, non-exclusive, worldwide licence to download, view, and use that Tip for personal, non-commercial purposes only. Players may not resell, publicly distribute, or otherwise exploit Tips.

7.3 Licence to Elevate Golf.
By uploading or creating content on the Platform, each User grants Elevate Golf a worldwide, non-exclusive, royalty-free licence to host, store, process, and display that content solely for the purposes of operating, securing, and improving the Platform. Elevate Golf may also process content in anonymised form to train and develop its technology, including AI and machine learning systems.

7.4 Marketing and Promotion.
Elevate Golf will not use Player submissions or Coach Tips for marketing, advertising, or public demonstration without the express consent of the User concerned. Users may be invited to opt in to such uses.

7.5 Sample and Demonstration Content.
Where Players or Coaches expressly consent, Elevate Golf may use their submissions or Tips for demonstration purposes, including in sample galleries, product testing, or community features. Consent may be withdrawn at any time, but will not affect prior lawful uses.

7.6 Restrictions on Use.
(a) Coaches may not download, reproduce, or redistribute Player submissions outside the Platform.
(b) Coaches may not use Player submissions for any purpose other than providing a Tip on the Platform.
(c) Players may not reproduce or distribute Tips outside the Platform except for their own personal use.

7.7 Anonymised Use.
Elevate Golf may process User content in anonymised or aggregated form for research, analytics, and service development. Anonymisation means that personal identifiers are removed so that the content cannot reasonably be linked back to any individual.

7.8 Intellectual Property of Elevate Golf.
All rights in the Platform itself, including its software, design, trademarks, and branding, belong to Elevate Golf or its licensors. Users must not copy, modify, or use Elevate Golf’s intellectual property except as permitted by these Terms.

“Elevate Golf” is a registered trademark of Elevate Golf International Limited.

7.9 Responsibility for Content.
Each User is solely responsible for the content they upload or create. Elevate Golf does not endorse or verify any User Content and accepts no responsibility for its accuracy. Elevate Golf may remove or restrict content that breaches these Terms, the Acceptable Use Policy, or applicable law.

Section 8 - Acceptable Use and Conduct

8.1 General Standard.
Users must use the Platform lawfully, responsibly, and in good faith. Conduct that undermines the integrity, safety, or fairness of the Platform is prohibited.

8.2 Prohibited Conduct.
Users must not:
(a) upload, share, or transmit unlawful, defamatory, obscene, offensive, or harmful content;
(b) harass, threaten, or abuse any Player, Coach, or Elevate Golf staff;
(c) attempt to bypass, disable, or interfere with the security or operation of the Platform;
(d) attempt to circumvent payment or engage in off-platform transactions;
(e) impersonate another person or misrepresent identity;
(f) infringe any intellectual property, privacy, or proprietary rights;
(g) use the Platform to distribute spam, solicitations, or unauthorised advertising;
(h) engage in any conduct that could damage Elevate Golf’s reputation or disrupt the community.

8.3 Additional Rules.
Specific behavioural rules and enforcement measures are set out in the Acceptable Use Policy, which forms part of these Terms.

8.4 Consequences.
Elevate Golf may suspend, restrict, or permanently terminate an Account where it reasonably believes a breach of this Section or the Acceptable Use Policy has occurred. Elevate Golf may also remove offending content without notice.

Section 9 - Termination and Suspension

9.1 Our Rights.
Elevate Golf may suspend, restrict, disable, or permanently terminate a User’s Account at any time where:
(a) the User breaches these Terms or any Policy;
(b) the User engages in fraud, abuse, or conduct harmful to Players, Coaches, or the Platform;
(c) we are required to do so by law, regulation, or a lawful authority;
(d) continuing access poses a risk to safety, security, or trust.

9.2 Immediate Action.
Where Elevate Golf reasonably considers urgent action is necessary to protect Players, Coaches, or the Platform, it may suspend or restrict access immediately and without prior notice.

9.3 Effect of Termination or Disablement.
Upon termination or permanent disablement of an Account:
(a) the User loses access to the Platform and all associated content;
(b) Elevate Golf may retain Account information in accordance with its Privacy Policy, including for fraud prevention, legal compliance, and audit purposes;
(c) any outstanding obligations (including payment of fees or taxes by Coaches) remain enforceable.

9.4 User Request to Close Account.
Users may request closure of their Account at any time through the Platform or by contacting Elevate Golf. In practice, closure results in the Account being disabled so that it can no longer be accessed. Account data may be retained in line with our Privacy Policy and data retention rules.

9.5 Survival of Terms.
Provisions of these Terms that by their nature are intended to survive termination or disablement (including intellectual property, licences, limitations of liability, and dispute resolution) shall continue in effect.

Section 10 - Disclaimers and Limitation of Liability

10.1 Marketplace Role.
Elevate Golf is a digital marketplace that connects Players with independent Coaches. Elevate Golf does not itself provide coaching services, and is not responsible for the content of any Tip or for the outcome of any coaching. All Tips are created and delivered by Coaches in their own capacity.

10.2 Coach Independence.
Coaches are independent professionals. They are not employees, agents, workers, or representatives of Elevate Golf. Nothing in these Terms creates any employment, partnership, or joint venture relationship between Elevate Golf and any Coach. Coaches act entirely on their own behalf and are solely responsible for the content of their Tips, their professional qualifications, and compliance with their own tax and legal obligations. Elevate Golf does not supervise, direct, or control the manner or method of coaching.

10.3 No Guarantee of Results.
Tips are for general educational purposes only. While Elevate Golf aims to connect Players with qualified Coaches, we cannot guarantee that a Tip will be accurate, suitable, or lead to any specific improvement in performance, handicap, fitness, nutrition, or mental wellbeing. Outcomes depend on many variables beyond the Platform’s control.

10.4 Platform Availability.
Elevate Golf strives to keep the Platform available, secure, and accurate, but we do not guarantee uninterrupted access or error-free operation. Temporary interruptions may occur due to maintenance, technical issues, or third-party services.

10.5 Third-Party Services.
The Platform relies on third-party services such as PayPal for payments, Amazon Web Services for hosting, and other vendors. Elevate Golf is not responsible for the availability, performance, or terms of these services. Users must comply with any separate terms imposed by those providers, including PayPal’s Terms of Service.

10.6 Exclusion of Certain Liability.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Subject to that:
(a) Elevate Golf is not liable for any indirect, incidental, special, or consequential loss, including loss of profits, data, goodwill, or opportunities;
(b) Elevate Golf is not liable for any act or omission of a Coach or a Player, including the content of Tips or submissions;
(c) Elevate Golf is not liable for any loss or damage arising from reliance on IQ Match™ scores or similar features, which are provided for guidance only.

10.7 Limitation of Liability.
To the fullest extent permitted by law, Elevate Golf’s total liability to any User arising out of or in connection with these Terms shall not exceed the greater of:
(a) the total amount paid by that User for Tips on the Platform in the twelve (12) months prior to the event giving rise to the claim; or
(b) one hundred United States Dollars (USD $100).

10.8 Acknowledgement.
By using the Platform, Users acknowledge that Elevate Golf is not responsible for the acts or omissions of Coaches or Players, that no guarantees of outcomes are given, and that their use of the Platform is at their own risk, subject always to these Terms.

Section 11 - Governing Law and Jurisdiction

11.1 Governing Law.
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales.

11.2 Jurisdiction.
Subject to Clause 11.3, the courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.

11.3 Arbitration.
(a) Coaches. For disputes involving Coaches, Elevate Golf may, at its sole discretion, require the matter to be resolved by binding arbitration under the London Court of International Arbitration (LCIA) Rules. The seat of arbitration shall be London, England. The language of arbitration shall be English.
(b) Players. For disputes involving Players acting as consumers, arbitration may only be used with the Player’s express consent. Otherwise, such disputes shall be heard in the courts of England and Wales.
(c) Scope. This Clause applies to disputes with or against Elevate Golf, as well as disputes between Users arising from use of the Platform.

11.4 Mandatory Local Rights.
If mandatory law in a User’s country grants additional rights or requires disputes to be heard in local courts, those provisions may apply in place of Clauses 11.2 and 11.3 to the extent required by law.

Section 12 - General Provisions

12.1 Changes to these Terms.
Elevate Golf may update these Terms from time to time. Where changes are material, we will give reasonable notice within the Platform or by email before they take effect. Continued use of the Platform after the effective date of new Terms constitutes acceptance of those Terms.

12.2 Entire Agreement.
These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, Refunds & Cancellations Policy, and The Coach Agreement (where applicable), form the entire agreement between Elevate Golf and the User. They replace any earlier written or oral agreements relating to the Platform.

12.3 Assignment.
Users may not assign, transfer, or subcontract their rights or obligations under these Terms. Elevate Golf may assign or transfer its rights and obligations without restriction, provided this does not materially affect Users’ rights.

12.4 Severability.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12.5 No Waiver.
Failure or delay by Elevate Golf to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.6 Third-Party Rights.
Except as expressly provided, these Terms do not create any rights enforceable by any person who is not a party to them.

12.7 Notices.
Any notices to Elevate Golf under these Terms must be sent in writing to legal@elevategolf.com. Notices will be deemed received on the next business day following transmission.
